Eligibility:
1. The “Big Green Egg” contest is open to individuals who are 18 years old or older at the time of entry.
2. Only legal residents of the United States are eligible to participate.
3. The contest is void where prohibited by law.
4. Employees of SouthEast Bank and their family members, its affiliates, subsidiaries, advertising and promotion agencies, and suppliers, as well as their immediate family members and individuals living in the same household, are not eligible to participate.
5. The contest is subject to all applicable federal, state, and local laws and regulations.
How to Enter:
1. All winners will be selected randomly.
2. To be eligible to win a prize, the entry must fulfill all specified campaign requirements.
3. Incomplete entries or entries that do not adhere to the rules or specifications may be disqualified at the sole discretion of SouthEast Bank.
4. Participants must provide the requested information.
5. Attempts to circumvent the rules by entering multiple times using multiple email addresses, identities, or devices may result in disqualification.
6. Any fraudulent methods or attempts to circumvent the rules may lead to the removal of submission eligibility at the sole discretion of SouthEast Bank.
Prizes:
1. Prizes awarded may be substituted at any time.
2. The actual or appraised value of the prize may differ at the time of award.
3. The specific details of the prize will be determined solely by SouthEast Bank.
4. No cash or other prize substitutions are permitted except at the discretion of SouthEast Bank.
5. The prize is nontransferable.
6. The contest winner is responsible for any and all prize-related expenses, including federal, state, and/or local taxes.
7. No substitution of the prize or transfer/assignment of the prize to others, or request for cash equivalent is allowed.
8. The winner must claim and take possession of the prize(s) at their closest or designated SouthEast Bank branch, without exceptions.
Agreement to Rules:
1. By participating in the contest and/or accepting any prize offer, the contestant agrees to be fully and unconditionally bound by these rules.
2. The contestant represents and warrants that they meet the eligibility requirements.
3. The contestant agrees to accept the decisions of SouthEast Bank as final and binding regarding the content of this campaign.
Contest Period:
1. Entries will be accepted online during the dates explicitly outlined here: August 1, 2023 at 12:01 am EST, through October 31, 2023 at 11:59 pm EST.
Odds:
1. The odds of winning depend on the number of eligible entries received.
Winner Selection and Notification:
1. The winner will be randomly selected from the list of entries.
2. The winner will be notified via email address and/or phone number within five (5) days following the selection.
3. SouthEast Bank shall not be liable if the winner fails to receive notifications due to spam, junk e-mail, or other security settings, or if the winner provides incorrect or non-functioning contact information.
4. If the winner cannot be contacted, is ineligible, fails to claim the prize within 7 days from the time of award notification, or fails to return a completed and executed declaration and release as required, the prize may be forfeited.
5. If the original winner forfeits the prize, SouthEast Bank is not obligated to select another winner but may choose to do so.
6. The receipt of the prize is subject to compliance with all federal, state, and local laws and regulations.
7. Any violation of these official rules by the winner, at the sole discretion of SouthEast Bank, will result in disqualification and termination of all winner privileges.
Rights Granted by You:
1. By entering the contest and submitting content (e.g., photo, video, text), you understand and agree that SouthEast Bank, anyone acting on behalf of SouthEast Bank, and SouthEast Bank’s licensees, successors, and assigns, have the right, where permitted by law, to print, publish, broadcast, distribute, and use your entry, name, portrait, picture, voice, likeness, image, statements about the campaign, and biographical information for news, publicity, information, trade, advertising, public relations, and promotional purposes.
2. This right extends to any media now known or developed in the future, without limitation, and without any further compensation, notice, review, or consent.
3. By entering, you represent and warrant that your entry is an original work of authorship and does not violate any third party’s proprietary or intellectual property rights.
4. If your entry infringes upon the intellectual property rights of another, you may be disqualified at the sole discretion of SouthEast Bank.
5. If your entry is claimed to infringe upon any third party’s proprietary or intellectual property rights, you agree to defend or settle against such claims at your sole expense.
6. You shall indemnify, defend, and hold harmless SouthEast Bank from any suit, proceeding, claims, liability, loss, damage, costs, or expenses arising out of such infringement or suspected infringement of any third party’s rights.
Terms & Conditions:
1. SouthEast Bank reserves the right, at its sole discretion, to cancel, terminate, modify, or suspend the campaign with or without cause.
2. In such cases, SouthEast Bank may select the winner from all eligible entries received prior to and/or after the action taken by SouthEast Bank.
3. SouthEast Bank reserves the right, at its sole discretion, to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the campaign or website, or violates these terms and conditions.
4. SouthEast Bank has the right, at its sole discretion, to maintain the integrity of the campaign, void votes for any reason, including but not limited to multiple entries from the same user from different IP addresses, multiple entries from the same computer exceeding the limit specified in the campaign rules, or the use of bots, macros, scripts, or other technical means for entering.
5. Any attempt by an entrant to deliberately damage any website or undermine the legitimate operation of the campaign may be a violation of criminal and civil laws.
6. In such cases, SouthEast Bank reserves the right to seek damages to the fullest extent permitted by law.
Limitation of Liability:
1. By entering the contest, you agree to release and hold harmless SouthEast Bank, its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, whether caused by negligence or not.
2. SouthEast Bank and its affiliates are not responsible for any technical failures, including but not limited to computer malfunctions, network or cable malfunctions, or other mechanical equipment failures.
3. SouthEast Bank is not responsible for the unavailability or inaccessibility of any transmissions, telephone, or Internet service.
4. SouthEast Bank reserves the right to void votes, disqualify participants, or seek damages for any attempt to undermine the legitimate operation of the campaign.
Disputes:
1. This campaign is governed by the laws of the United States and Tennessee, without respect to conflict of law doctrines.
2. By participating in the campaign, you agree that any disputes or causes of action arising out of or connected to the campaign shall be resolved individually, without resorting to any form of class action, and exclusively before a court located in Tennessee with jurisdiction.
3. You waive the right to seek punitive, incidental, or consequential damages, including attorney’s fees, other than your actual out-of-pocket expenses, arising from or related to your participation in the campaign.
4. You further waive all rights to have damages multiplied or increased.
Privacy Policy:
1. Information submitted with an entry is subject to the privacy policy stated on the SouthEast Bank website.
Sponsor:
1. The sponsor of the campaign is SouthEast Bank.
Third-Party Platforms:
1. The campaign hosted by SouthEast Bank is not sponsored, endorsed, administered by, or associated with SurveyMonkey, Facebook, Instagram, LinkedIn, Twitter, YouTube, Google, or any other media platform.
Talent Release:
1. By participating in this contest, you grant SouthEast Bank and its subsidiaries permission to use your image and likeness without payment or any other consideration.
2. You understand that your image may be edited, copied, exhibited, published, or distributed and waive the right to inspect or approve the finished product.
3. You waive any right to royalties or other compensation arising from or related to the use of your image.
4. You acknowledge that this release applies to photographic and video images collected as part of this contest and grants SouthEast Bank permission to use your image for various marketing materials and educational purposes.
Marketing Communication:
1. By participating in the contest and accepting any prize offer, you agree to receive periodic emails and SMS messages from SouthEast Bank and/or its affiliates about new products, specials, and promotions.
